Annulment Lawyers Make Tough Times Less Difficult

When a marriage is not considered to be valid, it can be nullified through either the court or in some religions, the church. Going through the court to get an annulment ensures that the process is legally binding and that all the proper steps are taken. Annulment lawyers have all the knowledge and experience that is required when going through with the proceedings but some don’t. The process of choosing the right one is as tedious as choosing a condemnation lawyer, debt settlement lawyer, drug lawyereviction lawyer or even shoplifting lawyer. Good condemnation attorneys, annulment attorneys, work injury lawyers and drug lawyers are hard to find these days because using them can be really costly. Best felony lawyers are even harder to find. There are few who are available but they ask for high fees. However, you still have to bear in mind that you have to have the best attorney so that your case will be a success.

Even though it isn’t quite as complicated as the process on how to get divorced and going through the divorce procedures, there are still laws and regulations that must be considered about annulments. When a marriage is annulled, things go back to the way they were before the marriage existed. Asking an advice from a mediation lawyer could be beneficial. Mediation lawyers are the best to work with when it comes to emotional issues. They know exactly how to handle things. When there are children involved, however, or personal property that needs to be distributed, the case can get more complicated. This is when an annulment attorney comes in handy, because they can keep the matter civil, and ensure all bases are covered.

There is a list of legal and valid reasons why a marriage can and should be nullified. Depending on the circumstance, the marriage will be termed as either void or voidable. In order for the marriage to be considered void, there must be a reason that made it invalid to begin with. One reason is if the person seeking an annulment is under legal age to be married.

The annulment can also be filed by a person representing the minor, such as a parent. In addition, if the two people are related too closely, an annulment will be granted. Another reason is if someone in the marriage has an existing marriage that has not dissolved or legally come to an end. These cases do not have a statute of limitations, and can be granted an annulment no matter how long it has been going on. Even in these seemingly easy cases, annulment lawyers make the process less stressful.

The other category is for marriages that are voidable. In these cases, there is a time limit that begins from when the condition is discovered. The laws vary by state regarding deadlines. Persons with an unsound mind that get into a union with someone qualify for an annulment. This is specified as persons who do not wholly understand and accept the concept of marriage. On the other hand, if someone is forced into a marriage they understand but do not consent to, they can file for annulment on grounds of duress.

Annulment lawyers can advise clients on what level the case can be handled. If the relationship was formed out of reasons for fraud, the marriage is not considered valid. For a marriage to be considered fraud, then it must be believed that the entire purpose of the marriage in every detail was for alternative reasons by one or both parties.

Finally, a marriage can legally be annulled if there is an issue between the couple regarding sexual matters. If one partner is not able to conceive or is physically unable to perform intercourse, the marriage can be annulled. Because any of these situations can get complex, having an annulment lawyer ensures ease and accuracy.  An annulment is a far easier solution than a divorce – because of all the  fees that can add up, such as from divorce attorneys or alimony lawyers.
